Bhutan National Legal Institute established the Legal Aid Center on 19 October 2022 at the Supreme Court Complex. The inaugural event was graced by Her Royal Highness Princess Sonam Dechan Wangchuck, the Honourable President of Bhutan National Legal Institute, and the Chief Justice of Bhutan. Along with the inauguration of the Center, two documents were launched, namely, the Legal Aid Inception Document and the Legal Aid Rules 2022.
Legal aid is indispensable, especially for indigent persons, to have fair and full access to the justice system. With the establishment of the Center, legal aid services will be provided in an organized, systematic, and purposeful manner to best serve the needs of the people. Legal aid services provided by the Center will include legal advice, assistance, and representation subject to both means and merit tests.
The Center will provide legal aid services in both civil and criminal cases, with funding support from the State. In civil cases, legal aid services will only include legal advice and assistance, with legal representation being granted only if the interest of justice so requires. Whereas, in criminal cases, all three types of legal services will be available. For now, criminal legal aid services shall only be available to indigent accused charged with offences that are felony in nature. Legal aid services will also be available to victims and vulnerable persons who require legal advice and assistance.
In the absence of a formal legislative framework, the Center shall be guided by the Legal Aid Rules 2022. The Rules cover all aspects related to the delivery of legal aid services such as determination of eligibility criteria, application and review process, assignment of service providers, and service standards.
The Legal Aid Center has been successfully established with financial support from the Royal Government of Bhutan and the United Nations Development Programme (UNDP, Bhutan).
